1. Acceptance
By accessing or using the Calltura platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you are accepting on behalf of a business, you represent that you have authority to do so.
“Calltura” refers to the AI voice receptionist service operated by its founders. Contact: hello@calltura.com.
2. Description of service
Calltura provides an AI-powered voice agent that answers inbound phone calls and browser-based WebRTC calls on behalf of client businesses. The Service includes:
- Real-time voice conversation via Gemini Live (Vertex AI)
- Automated appointment booking via Cal.com
- Knowledge base retrieval (FAQ lookups via pgvector RAG)
- Call transcription, recording, and portal-based review
- Escalation to human operators where configured
3. Accounts and access
Access to the admin portal is controlled by a password set in each client deployment’s environment. You are responsible for keeping this password confidential. Calltura is not liable for unauthorised access resulting from password disclosure.
4. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or to violate any applicable law.
- Deploy the agent in contexts where callers have not been informed they may be speaking with an AI, in violation of applicable consumer protection law.
- Use the Service to transmit spam, misleading content, or to impersonate third parties fraudulently.
- Attempt to reverse-engineer, scrape, or overload the Service.
5. AI limitations and disclaimers
The Calltura agent is powered by large language models (Google Gemini Live) which may occasionally produce inaccurate, incomplete, or unexpected outputs. Calltura does not guarantee that the agent will handle every call correctly or that bookings made by the agent are error-free.
You are responsible for monitoring call logs, reviewing bookings, and supervising the agent’s behaviour in your deployment. You should implement human escalation routes for complex, emergency, or high-value calls.
6. Emergency calls
The Calltura agent includes an escalation flow for P1 gas-safety emergencies (gas leaks, suspected carbon monoxide exposure). However, Calltura does not guarantee the agent will correctly identify all emergency situations. You must not rely solely on the AI agent for life-safety critical call handling. Ensure a human escalation path is available at all times.
7. Intellectual property
Calltura retains all intellectual property rights in the platform, including prompt templates, the admin portal codebase, and the agent runtime. Your call data (transcripts, recordings, booking records) remains your property.
8. Pricing and payment
Pricing is agreed separately in your service agreement. Calltura reserves the right to update pricing with 30 days’ written notice. Continued use after notice constitutes acceptance of new pricing.
9. Service availability
Calltura targets 99.5% monthly uptime for call handling. Scheduled maintenance will be announced in advance. We are not liable for downtime caused by third-party providers (LiveKit, Google Cloud, Telnyx, Supabase).
10. Limitation of liability
To the maximum extent permitted by law, Calltura’s aggregate liability for any claim arising from the Service is limited to the fees paid by you in the three months preceding the claim. Calltura is not liable for indirect, incidental, or consequential losses, including lost revenue or missed bookings.
11. Termination
Either party may terminate with 30 days’ written notice. Calltura may suspend access immediately for material breach (e.g. non-payment, illegal use). On termination, call data is available for export for 30 days, after which it is deleted.
12. Governing law
These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes
We may update these Terms. Material changes will be communicated by email with 30 days’ notice. Continued use of the Service constitutes acceptance.
